garnish (“we,” “us,” “our”) operates the website garnish.menu and provides AI-powered menu audit services. This page covers our Terms of Service, Privacy Policy, AI Disclosure, Earnings Disclaimer, and Limitation of Liability. We’ve written it in plain English because we think you should actually be able to read your legal agreements.
1. Terms of Service
By using garnish.menu or purchasing any garnish service, you agree to these terms. If you don’t agree, please don’t use the service.
What we provide. garnish offers AI-powered analysis of restaurant menus. Our service evaluates your menu’s copy, pricing presentation, visual hierarchy, menu engineering, competitive positioning, and compliance. We deliver findings, recommendations, and estimated revenue impacts based on that analysis.
What you provide. You upload or share a menu that you have the right to share. By submitting a menu, you confirm that you are authorized to do so — either as the restaurant owner, an authorized representative, or with permission from the owner. You retain all rights to your menu content.
Acceptable use. You agree to use garnish for legitimate business purposes related to restaurant menu evaluation. You will not use our service to submit menus you don’t have authorization to analyze, attempt to reverse-engineer our analysis methodology, or resell our reports without written permission.
Payments and refunds. All payments are processed securely through Stripe. Prices are listed on our website and are subject to change. Because our service delivers a complete digital product upon purchase, all sales are final. If you believe your audit contains a material error, contact us at [email protected] and we’ll make it right.
Account termination. We reserve the right to refuse service to anyone, at any time, for any reason. We won’t do this without cause, but we need the legal ability to protect ourselves and our other users.
Changes to these terms. We may update these terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. Continued use of the service after changes constitutes acceptance of the new terms.
2. Privacy Policy
We take your privacy seriously and collect only what we need to deliver the service.
Information we collect. When you use garnish, we collect the information you provide directly: your name, email address, restaurant name, city and state, and the menu you upload. We also collect standard technical information through our website: IP address, browser type, pages visited, and cookies necessary for the site to function.
How we use your information. We use your information to deliver your menu audit, communicate with you about your order, improve our service, and send occasional marketing emails (which you can unsubscribe from at any time). We do not sell, rent, or trade your personal information to third parties.
Menu data. The menus you upload are processed by our AI analysis engine to generate your audit. We may retain menu data to improve our service quality, but we will never publicly share your menu, your restaurant’s name, or your audit results without your explicit written permission. If we use anonymized, aggregated data from audits (for example, “68% of menus we analyzed had pricing psychology issues”), no individual restaurant will be identifiable.
Third-party services. We use the following third-party services to operate garnish: Stripe for payment processing, Anthropic’s Claude for AI analysis, Bluehost for web hosting, and Google Workspace for email. Each of these services has its own privacy policy governing how they handle data. We only share the minimum information necessary for each service to function.
AI processing. Your menu content is sent to Anthropic’s Claude custom API for analysis. Anthropic’s data retention and privacy policies apply to this processing. We encourage you to review Anthropic’s privacy policy for details on how they handle data sent through their API. Per Anthropic’s commercial terms, data submitted through their API is not used to train their models.
Data retention. We retain your personal information and menu data for as long as necessary to provide the service and for reasonable business purposes (such as resolving disputes or complying with legal obligations). You may request deletion of your data at any time by emailing [email protected].
Children’s privacy. garnish is a business service intended for restaurant owners and operators. We do not knowingly collect information from anyone under the age of 18.
3. AI Disclosure
Transparency matters to us, so here’s exactly how AI fits into what we do.
garnish is an AI-powered service. The core analysis engine behind every garnish audit is artificial intelligence, specifically Anthropic’s Claude. When you submit a menu, our proprietary audit AI performs the analysis: reading your menu content, evaluating it across five dimensions, generating findings, writing recommendations, and estimating revenue impacts.
Human oversight. While AI performs the analysis, human operators review outputs for quality, accuracy, and relevance. We do not blindly pass through raw AI output. That said, AI-generated content may occasionally contain errors, and we cannot guarantee that every finding or recommendation will be perfectly accurate for your specific situation.
AI limitations. AI is a powerful tool, but it has limitations. Our analysis is based on what is visible on your menu and publicly available information about your market. We cannot account for factors we can’t see: your food costs, your kitchen capacity, your customer demographics, local regulations, or the dozens of other variables that affect a restaurant’s success. Our recommendations are informed suggestions, not guarantees.
Evolving technology. AI capabilities improve over time. The quality and depth of our analysis may change as the underlying technology evolves. We are committed to using the best available tools and to being transparent about how they work.
4. Earnings & Results Disclaimer
This is the important one. Please read it carefully.
No guaranteed results. garnish provides analysis, recommendations, and estimated revenue impacts based on industry research, published studies, and AI-generated insights. These estimates are exactly that — estimates. We do not and cannot guarantee any specific financial outcome, revenue increase, cost savings, or business result from implementing our recommendations.
Revenue estimates are illustrative. When we cite statistics like “removing dollar signs can increase average spend by 8%” or provide an estimated annual revenue impact, these figures are drawn from published academic research and industry data. They represent averages across studies and may not reflect what will happen at your specific restaurant. Your results will depend on your market, your customers, your execution, and countless other factors unique to your business.
Not professional consulting. garnish is a technology-assisted analysis tool. Our reports are not a substitute for professional business consulting, financial advice, legal counsel, or accounting services. We are not licensed financial advisors, business consultants, or food safety experts. If our audit surfaces compliance or regulatory concerns, we strongly recommend consulting with a qualified professional in your jurisdiction.
Research citations. Where we reference academic studies or industry statistics in our audits, we make good-faith efforts to cite credible, published sources. However, we do not independently verify every study, and research findings may not generalize to every restaurant or market. Treat cited statistics as directional guidance, not precise predictions for your business.
Your responsibility. Any changes you make to your menu based on our recommendations are entirely your decision and your responsibility. We provide the analysis; you decide what to do with it. We are not liable for business decisions made based on our reports.
5. Limitation of Liability
Service provided “as is.” garnish is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of our analysis for any particular purpose. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of damages. To the fullest extent permitted by law, garnish, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our service, including but not limited to lost profits, lost revenue, lost data, or business interruption — regardless of whether we were advised of the possibility of such damages.
Maximum liability. Our total liability to you for any claim arising from or related to our service shall not exceed the amount you paid to garnish in the twelve (12) months preceding the claim.
Indemnification. You agree to indemnify and hold harmless garnish and its founders from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of the service, your violation of these terms, or your violation of any third party’s rights.
6. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict of law principles. Any disputes arising from these terms or your use of our service shall be resolved in the state or federal courts located in Arkansas.
